I was going to write one of my occasional constitutional rants today, but I'm too tired. Maybe tomorrow.

If you want to know what's set me off, go and see what Uncle's Tony and Blunkett are proposing under Clause 11 of the Asylum and Immigration (Treatment of Claimants etc.) Bill.

What's that sound, I hear you ask?

It's two madmen with the power of government taking lump hammers to the British Constitution. Again.

Go to the Parliament web page and do a search on the Bill. It's all there. Read Clause 11 and think the implications through.

In cheerier news, I have finished the first draft of Luciano and e-mailed it to [livejournal.com profile] pax_draconis. I suppose I'd better start another, now.

Difficult to read a real bill, but it does look like they are trying to set up the tribunal so it is not answerable under the law to any other court. I suspect it is illegal under EU law which would surely assert the primacy of the European Court of Human Rights on this issue.

The area of section 11 that looks iffy is:

Subsections (1) and (2)—
(a)prevent a court, in particular, from entertaining proceedings to
determine whether a purported determination, decision or
action of the Tribunal was a nullity by reason of—
(i)lack of jurisdiction,
(ii)irregularity,
(iii)error of law,
(iv)breach of natural justice, or
(v)any other matter, but

True enough. Mind you it will keep the Daily Mail brigade happy and probably win Tony another election. Success at any price as usual.
